PERSONAL DATA PROTECTION NOTICE

Tenaga Nusantara Sdn Bhd operates the Kluang Mall (“Kluang Mall”) is committed to the protection of your personal data. The Personal Data Protection Act, 2010 ("Act") regulates the processing of personal data in commercial transactions and the Act requires Tenaga Nusantara Sdn Bhd to inform and explain to you how Kluang Mall collects and process personal data provided by you to Kluang Mall and/or the website operated by Kluang Mall at http://www.kluangmall.com ("Website"). The terms "personal data", "processing" "commercial transactions" and "relevant person" used in this Personal Data Protection Notice ("Notice") shall have the meaning prescribed in the Act. For the purposes of this Notice the expression "we" or "us" shall refer to Tenaga Nusantara Sdn Bhd, whilst, the expression "you" or "your" shall refer and include the customer, potential customer, vendor, supplier, tenant, potential tenant or service provider and/or relevant person seeking or requesting the products and/or services from Kluang Mall.

TYPES OF PERSONAL DATA AND SOURCES OF PERSONAL DATA

The personal data provided by you and/or obtained independently by us from other lawful sources (if any such as from public depositories, credit reporting agencies, public domain, your employer, former employer and other authorized third parties) in our forms, agreements, Website, and/or other similar documents or usage of closed-circuit television ("CCTV") systems in Kluang Mall may include information concerning name, identity card number, passport number, address, phone numbers (such as handphone, house and office), gender, occupation, designation, email address, name of school, vehicle registration number, model of vehicle, type of vehicle, information in audio and/or video format (including voice, video recording, CCTV, security recording and images (including photographs) (collectively "Personal Data").

Your visit to the Website may be recorded for statistical analysis purposes on the number of visitors to the Website and general usage patterns. Some of this information will be gathered through the use of "cookies". A cookie is a small file which asks permission to be placed on your computer's hard disk. Once you agree, the file is added and the cookie helps analyse web traffic or lets you know when you visit a particular site. We only use this information for statistical analysis purposes and then the data is removed from the system. • to facilitate special requirements such as those relating to any disability or medical condition which may effect the chosen services;

• to communicate with you, deliver notices, services or facilities, respond to your enquiries and clarifications via SMS, phone call, email, fax, mail and/or any other appropriate communication channels;

• to conduct research and internal marketing analysis;

• providing you with information of marketing, sale or promotion of Kluang Mall's products and/or services from Kluang Mall's tenants, newsletters, periodicals, lucky draws, contests and/or surveys via SMS, phone call, email, fax, mail and/or any other appropriate communication channels unless you have otherwise notified us that you do not wish for us to process your Personal Data for such purpose at the address stated below in this Notice;

• conduct appropriate checks for credit-worthiness in the ordinary course of our business;

• public disclosure and use of your Personal Data, images, photographs, voice and video recording for publicity purposes without payment or compensation if you become a winner in a contest;

• for crime detection and prevention, internal investigations, compliance, audit or security purposes;

• to enforce contractual and legal rights and obligations;and

• to meet legal and regulatory requirements.

You hereby confirm that the Personal Data given by you or obtained from you is sufficient, accurate, complete and not misleading and that such Personal Data is necessary for us to provide our products and/or services to you. If you choose not to provide such Personal Data or if such Personal Data is insufficient, inaccurate, incomplete and/or misleading, Kluang Mall may not be able to provide you with the products and/or services you require or the required level of service.

DISCLOSURE OF PERSONAL DATA (WITHIN AND/OR OUTSIDE MALAYSIA)

• In order to deliver the products and/or services you require, you hereby consent and authorize us to disclose your Personal Data to the following parties (within and/or outside Malaysia):

• our parent company, subsidiaries, related and associated companies;

• our employees, consultants, accountants, auditors, lawyers, advisors, agents, contractors, vendors, co-marketing partner, service providers, merchants, financial institutions or shopping mall tenants to provide customer support, products and/or services;

• actual or proposed assignees or transferees or buyers of any rights/businesses/assets of Kluang Mall;

• service and product providers (including those who assist us in providing the Website) for Kluang Mall's operational, administration and development requirements;

• your immediate family members and/or emergency contact person as may be notified to Kluang Mall from time to time;

• where required by law, legal processes, debt collection, queries from the relevant authorities and/or matters relating to the life and death, security or property of an individual or the security or property of a corporation;

• the general public by publishing your Personal Data, images, photographs, voice and video recording for publicity purposes without payment or compensation if you become a winner in a contest.

RIGHT TO ACCESS AND/OR CORRECT PERSONAL DATA

You have the right to:

• check whether we hold your Personal Data and request access to the same:

• correct any Personal Data that is inaccurate, incomplete and outdated;

• withdraw in full or in part your consent subject to any contractual conditions and legal restrictions;

• communicate to us your objection to the use of your Personal Data for marketing purposes.

You are to put your request in writing for security reasons and verification purposes. In accordance with the Act, Kluang Mall will charge prescribed processing fee for all Personal Data access request made by you as follows:

    1 Data access request for your Personal Data with a copy RM 10
    2 Data access request for your Personal Data without a copy RM 2
    3 Data access request for your sensitive personal data with a copy RM 30
    4 Data access request for your sensitive personal data without a copy RM 5

In the event we refuse to adhere to your request for access and/or correction to your Personal Data we will inform you of our reason for the refusal.

CONSENT FROM RELEVANT PERSON

In the event you provide Personal Data of any relevant person (such as emergency contact person, parents if the customer is a minor, court appointed guardian, authorised representatives, contractors, lawyers, financiers), then this Notice shall apply to the relevant person.

You warrant to Kluang Mall that you have the authority or have been authorized by the relevant person, to the provision of Personal Data of the relevant person to Kluang Mall for the purposes and disclosure as stated in this Notice and you undertake to extend a copy of this Notice to the relevant person. The provision of this Notice shall be deemed as notice given to and consent obtained from the relevant person.

CHANGES TO PERSONAL DATA

We will ensure your Personal Data is accurate, complete and up-to-date therefore we request that if there are changes to your Personal Data you should notify us directly at contact details set out above.

MODIFICATION OF THE NOTICE

We may review and update this Notice from time to time to reflect changes in the Act. The latest version of the Notice will be made available upon your request at the above address or available at www.kluangmall.com. By continuing receiving and obtaining products and/or services from Kluang Mall following the modifications or changes to this Notice shall signify your acceptance to such modifications or changes.

CONFLICT

In the event of any inconsistency between the English version and the Bahasa Malaysia version of this Notice, the English version shall prevail over the Bahasa Malaysia version.

NOTIS PERLINDUNGAN DATA PERIBADI

Tenaga Nusantara Sdn Bhd adalah pengendali kepada Kluang Mall ("Kluang Mall") dan amat komited dalam melindungi data peribadi anda. Akta Perlindungan Data Peribadi, 2010 ("Akta") adalah Akta yang mengawal segala pemprosesan data peribadi di dalam transaksi komersial. Akta ini memerlukan Tenaga Nusantara Sdn Bhd memberitahu dan menjelaskan kepada anda tentang bagaimana Kluang Mall mengumpul dan memproses data peribadi yang diberikan oleh anda kepada Kluang Mall dan/atau di laman web yang dikendalikan Kluang Mall di http://www.kluangmall.com ("Laman Web").

Terma-terma yang terdapat di dalam Notis Perlindungan Data Peribadi ("Notis") ini seperti "data peribadi", "pemprosesan", "transaksi komersial", dan juga "orang yang berkaitan" membawa makna yang sama sepertimana yang dinyatakan di dalam Akta. Untuk tujuan Notis ini, ungkapan seperti "kami" adalah merujuk kepada Tenaga Nusantara Sdn Bhd, manakala ungkapan "anda" adalah merujuk dan merangkumi pelanggan, bakal pelanggan, penjual, pembekal, penyewa, bakal penyewa atau pembekal perkhidmatan dan/atau orang yang berkaitan yang ingin mendapatkan atau meminta tentang produk-produk dan/atau perkhidmatan-perkhidmatan dari Kluang Mall.

JENIS-JENIS DATA PERIBADI DAN SUMBERNYA

Data peribadi yang diberikan oleh anda dan/atau yang telah kami dapatkan dengan sendirinya dari sumber-sumber yang sah (seperti depositiri awam, agensi pelapor kredit, domain awam, majikan anda, bekas majikan anda dan juga pihak ketiga yang telah diberi kuasa,) di dalam borang-borang kami, perjanjian, Laman Web, dan/atau lain-lain dokumen yang sehubungan dengannya atau penggunaan sistem litar kamera tertutup ("CCTV") yang terdapat di dalam Kluang Mall yang boleh merangkumi maklumat mengenai nama anda, nombor kad pengenalan, nombor pasport, alamat rumah, nombor telefon ( seperti telefon bimbit, telefon rumah dan juga pejabat), jantina, status perkahwinan, pekerjaan, jawatan, alamat e-mel, nama sekolah, nombor pendaftaran kenderaan, model kenderaan, jenis kenderaan, maklumat dalam format audio dan/atau video (termasuk rakaman suara, video, CCTV, rakaman keselamatan dan imej-imej (termasuk gambar) (secara kolektifnya "Data Peribadi").

Lawatan anda ke Laman Web boleh direkod bagi tujuan analisis statistik jumlah pengunjung ke Laman Web dan corak penggunaan umum. Sesetengah maklumat ini akan dikumpulkan melalui penggunaan "cookies". •untuk menilai dan memproses permintaan anda berkaitan produk-produk dan/atau perkhidmatan-perkhidmatan kami, membantu dalam transaksi komersial bersama anda termasuk dan tidak terhad kepada penyediaan segala perjanjian-perjanjian yang berkaitan dan juga dalam menyelia akaun-akaun kami dan segala rekod operasi, pentadbiran dan keperluan pembangunan Kluang Mall;

•sebagai pengesahan identiti anda, mengemaskini rekod anda, memproses invois-invois, pembayaran, resit-resit, pungutan hutang, pelaksanaan khidmat sokongan pelanggan dan perkhidmatan, dan juga menyediakan permintaan produk-produk dan/atau perkhidmatan-perkhidmatan lain yang dijalankan sehubungan dengan perniagaan kami;

•penglibatan anda dalam cabutan bertuah, pertandingan promosi atau kempen yang diadakan oleh kami atau bagi pihak kami;

•untuk memudahkan keperluan khas dalam perkara yang melibatkan ketidakupayaan atau keadaan perubatan yang boleh melaksanakan perkhidmatan yang dipilih;

•untuk tujuan berkomunikasi dengan anda, penyampaian notis-notis, perkhidmatan-perkhidmatan atau kemudahan-kemudahan, maklum balas segala pertanyaan anda dan membuat penjelasan melalui SMS, panggilan telefon, e-mel, faks, surat dan/atau lain-lain saluran komunikasi yang sewajarnya;

•untuk menjalankan penyelidikan dan analisis pemasaran dalaman;

•menyediakan anda dengan maklumat pemasaran, jualan murah atau promosi produk-produk dan/atau perkhidmatan-perkhidmatan yang terdapat di Kluang Mall yang dibuat oleh penyewa-penyewa Kluang Mall, surat berita, terbitan berkala, cabutan bertuah, peraduan dan/atau kaji selidik melalui SMS, panggilan telefon, e-mel, faks, surat dan/atau lain-lain saluran komunikasi yang sewajarnya. Sekiranya anda tidak membenarkan kami untuk memproses Data Peribadi anda bagi tujuan-tujuan di atas, anda boleh memaklumkan kepada kami melalui alamat yang disediakan di dalam Notis ini;

•melakukan pemeriksaan yang sepatutnya dalam menilai kelayakan kredit anda yang dijalankan sehubungan dengan perniagaan kami;

•pendedahan umum dan menggunakan Data Peribadi, imej-imej, gambar-gambar, rakaman suara dan video anda bagi tujuan publisiti tanpa sebarang bayaran atau pampasan sekiranya anda adalah pemenang di dalam sesebuah peraduan;

•untuk tujuan pencegahan dan mengesan jenayah, siasatan dalaman, pematuhan, audit atau bagi tujuan keselamatan;

•bagi menguatkuasakan hak dan tanggungjawab kontrak dan undang-undang; dan

•bagi tujuan memenuhi kehendak undang-undang dan peraturan.

Anda dengan ini telah mengesahkan bahawa Data Peribadi yang diberikan oleh anda atau yang diperolehi dari anda adalah mencukupi, tepat, lengkap dan tidak mengelirukan dan Data Peribadi tersebut adalah penting bagi kami dalam menyediakan produk-produk dan/atau perkhidmatan-perkhidmatan kepada anda. Sekiranya anda memilih untuk tidak memberi Data Peribadi anda atau sekiranya Data Peribadi anda tersebut adalah tidak mencukupi, tidak tepat, tidak lengkap dan/atau mengelirukan, Kluang Mall tidak akan dapat menyediakan anda dengan produk-produk dan/atau perkhidmatan-perkhidmatan yang anda perlukan ataupun pada tahap perkhidmatan yang anda perlukan.

PENDEDAHAN DATA PERIBADI (DI DALAM DAN/ATAU DI LUAR MALAYSIA)

Dalam memberikan khidmat produk-produk dan/atau perkhidmatan-perkhidmatan yang anda perlukan, anda dengan ini memberi kebenaran dan kuasa kepada kami untuk mendedahkan Data Peribadi anda kepada pihak-pihak seperti yang berikut (dalam dan/atau di luar Malaysia):

•syarikat induk, subsidiari-subsidiari, syarikat-syarikat bersekutu dan syarikat-syarikat yang berkaitan dengan kami;

•pekerja-pekerja kami, perunding-perunding, akauntan-akauntan, juruaudit-juruaudit, peguam-peguam, penasihat-penasihat, ejen-ejen, kontraktor-kontraktor, penjual-penjual, rakan pemasaran, penyedia perkhidmatan, peniaga-peniaga, institusi-institusi kewangan atau penyewa-penyewa pasaraya yang menyediakan khidmat sokongan pelanggan, produk-produk dan/atau perkhidmatan-perkhidmatan;

•pemegang serah hak atau bakal penerima pindahan atau pembeli hak-hak/perniagaan/asset Kluang Mall;

•penyedia perkhidmatan-perkhidmatan dan produk-produk (termasuk sesiapa yang membantu kami dalam menyediakan Laman Web) untuk operasi, keperluan pentadbiran dan pembangunan Kluang Mall;

•ahli keluarga terdekat anda dan/atau orang yang dihubungi ketika kecemasan sebagaimana yang dimaklumkan kepada Kluang Mall dari semasa ke semasa;

•apabila dikehendaki undang-undang, pemprosesan undang-undang, pungutan hutang, permintaan daripada pihak-pihak berkuasa yang berkaitan dan/atau perkara yang berhubungan dengan hidup dan mati, keselamatan atau harta seseorang atau keselamatan atau harta sesebuah syarikat;

•kepada orang awam dengan menyiarkan Data Peribadi, imej-imej, gambar-gambar, perakam suara dan video anda untuk tujuan publisiti tanpa bayaran atau pampasan sekiranya anda menjadi pemenang di dalam sesebuah peraduan.

HAK AKSES DAN/ATAU MEMBETULKAN DATA PERIBADI

Anda berhak untuk:

•menyemak sama ada kami menyimpan Data Peribadi anda dan meminta akses pada masa yang sama;

•membetulkan apa-apa Data Peribadi yang kurang tepat, tidak lengkap dan yang tidak dikemaskini;

•memaklumkan kami bahawa anda ingin menarik balik (sepenuhnya atau sebahagian) kebenaran anda yang telah diberikan kepada kami sebelum ini, tertakluk kepada syarat-syarat kontrak dan juga sebarang sekatan undang-undang;

•berhubung dengan kami dalam membuat bantahan sekiranya Data Peribadi anda digunakan bagi tujuan pemasaran.

Selaras dengan Akta, Kluang Mall akan mengenakan fi seperti yang ditetapkan di dalam Akta, terhadap sebarang permintaan mengakses Data Peribadi yang diminta oleh anda seperti yang berikut:

KEBENARAN DARI ORANG YANG BERKAITAN

Sekiranya anda membekalkan Data Peribadi mana-mana orang yang berkaitan (seperti orang untuk dihubungi sewaktu kecemasan, ibu bapa kepada pelanggan yang masih lagi di bawah umur, penjaga yang dilantik oleh mahkamah, wakil-wakil yang diberi kuasa, kontraktor, peguam-peguam, ahli kewangan), maka Notis ini hendaklah terpakai ke atas orang yang berkaitan.

Anda juga memberi jaminan kepada Kluang Mall bahawa anda mempunyai kuasa atau telah diberi kuasa oleh orang yang berkaitan, dengan memberikan Data Peribadi orang yang berkaitan kepada Kluang Mall bagi tujuan-tujuan dan pendedahan seperti yang terkandung di dalam Notis ini dan anda juga bertanggungjawab untuk melanjutkan satu salinan Notis ini kepada orang yang berkaitan. Kandungan di dalam Notis ini hendaklah dianggap sebagai notis yang diberikan kepada dan dengan kebenaran yang telah diperolehi dari orang yang berkaitan.

PERUBAHAN PADA DATA PERIBADI

Kami akan memastikan agar Data Peribadi anda adalah tepat, lengkap dan merupakan maklumat yang terkini. Oleh itu, sekiranya ada sebarang perubahan pada Data Peribadi anda, anda perlu menghubungi kami secara terus melalui butiran untuk dihubungi yang telah disertakan di atas.

PENGUBAHSUAIAN PADA NOTIS

Dengan menerima dan memperolehi produk-produk dan/atau perkhidmatan-perkhidmatan secara beterusan dari Kluang Mall, segala pengubahsuaian atau pengubahan pada Notis ini merupakan penerimaan anda terhadap segala pengubahsuaian atau pengubahan pada Notis ini.

KONFLIK

Sekiranya ada ketidakselarasan di antara Notis versi Bahasa Inggeris dan juga Bahasa Malaysia, versi Bahasa Inggeris hendaklah diguna pakai dan didahulukan dari notis versi Bahasa Malaysia.
